An Australian labour hire provider must confirm that each worker is allowed to work, collect the tax and superannuation details the ATO requires, give new employees the prescribed information, and, in several states, hold a licence. Work rights are Commonwealth law, labour hire licensing is state law, and the two meet in the same worker file. This article sets out what the framework requires, what each check compares, and where document validation saves time.

What documents must an Australian labour hire provider collect?

A provider must establish that the worker is an Australian citizen, permanent resident or holds a visa with work rights, and must collect a Tax File Number (TFN) declaration and superannuation details when the worker starts. Visa status is checked through the Department of Home Affairs' Visa Entitlement Verification Online (VEVO) service, which shows whether the visa is current and whether it carries work conditions.

Student visa holders are subject to a limit on work hours per fortnight, and some visa subclasses restrict the type of work or the employer. The agency has to read the conditions, not just see that a visa exists.

What does the Migration Act require of employers?

Under Division 12 of Part 2 of the Migration Act 1958, it is an offence to allow an unlawful non-citizen to work, or a lawful non-citizen to work in breach of a visa condition, and employers must also not refer such workers to other businesses. The text is on legislation.gov.au. The provisions carry both criminal and civil penalties, and the Act gives employers a defence if they carried out a VEVO check and the check showed the worker was allowed to work. A VEVO check made and recorded at the time of hire is therefore the single most useful piece of evidence in the file.

Labour hire providers should note that the referral rule matters for them in a specific way. An agency that places a worker with a host is both the employer and the referrer, so a failed check exposes the agency twice. Repeat checks are needed when a visa has an end date during the placement.

Which state labour hire licences apply?

Queensland, Victoria, South Australia and the ACT each run a labour hire licensing scheme, and a provider placing workers there must hold a licence and may be required to name it in advertising. The Victorian regulator, the Labour Hire Authority, publishes the licence register that host businesses can search. Hosts that use unlicensed providers can face penalties too, so many require proof of licence in the contract.

The Fair Work system adds duties on the employment side. New employees must receive the Fair Work Information Statement, and the Fair Work Ombudsman provides guidance on minimum wages, awards and the rules on pay for labour hire workers. Superannuation is paid on top of wages, at 12 per cent since 1 July 2025. The Australian Taxation Office publishes the TFN declaration and super choice requirements.

What do labour hire coordinators ask most often?

Three questions recur on HR and staffing forums. First: does a VEVO check have to be repeated? Repeat it when the visa has an expiry during the placement or when conditions might change, and record each result. Second: can I ask for a 100-point check? There is no general legal 100-point requirement for employment, so ask for the documents you need to confirm identity and work rights and apply the same standard to everyone. Third: who is liable, the provider or the host? The provider is the employer, but a host that knowingly uses a worker without work rights has its own exposure.

How should worker data be protected?

The Privacy Act 1988 and the Australian Privacy Principles apply to most employers with annual turnover above $3 million and to all providers of certain services, and a notifiable data breach scheme requires notice to the OAIC and affected people for eligible breaches. The Office of the Australian Information Commissioner publishes guidance. The employee records exemption means some employee information is outside the Act, but identity documents collected from job applicants and agency workers often fall within it, so treat them as covered.
